Terms and Conditions

The terms and conditions set forth in this document is an agreement between you (herein referred to as “client”, “traveler” or “lead traveler”) and Luxury Vacations and Travel, LLC (herein referred to as “we”, “us” or “our company”).

As a condition to conduct business with Luxury Vacations and Travel, LLC, you must agree to these terms and conditions (also referred to as "service agreement"). It is the responsibility of the lead traveler and/or person responsible for payment of services to inform ALL accompanying travelers of these terms and conditions. By submitting payment for bookings or services, you, the lead traveler and/or person responsible for payment of services, acknowledge that you have received, read, informed accompanying travelers and accept these terms and conditions.

1. QUOTES:

Quotes are just that, Quotes. When a quote is provided to you, the pricing is accurate as of the time the quote was completed. Pricing and availability is subject to change at any time and cannot be guaranteed. Pricing is subject to change until booking is made AND payment has been applied to the booking.

2. BOOKING:

Once you contact us to inquire about a vacation, we will schedule a consultation with you to understand your requirements and help determine if we are a good fit for your travel needs. If we both agree to proceed, we will send you a client information form and our service agreement. A NON-REFUNDABLE planning/service fee will be required upon submission of your client information form/service agreement and before any services are rendered. The non-refundable fee amount is based on services required. NOTE: Non-refundable planning/service fee is a fee charged by Luxury Vacations and Travel, LLC for services rendered and is separate from your trip cost. Your trip cost is paid directly to the supplier (see payment section below).

Once we receive your service agreement and NON-REFUNDABLE planning/service fee, we will begin curating a customized itinerary based on the information you provide. Once you have agreed upon an itinerary, we will secure that itinerary for you with a deposit or full trip cost depending how far your booking date is from your travel date. Deposits and trip costs vary based on the supplier used to book your itinerary. Final payments are typically due anywhere from 2-6 months prior to travel (depends on supplier and trip type). All quotes/prices are subject to change until a deposit is made.

Once your reservation is made, add-on components (excursions, spa, shows, dining, etc.) may be added any time prior to final payment. This may vary by supplier. Two to three weeks prior to departure, we will send you your travel documents, which will include your reservation and all agreed upon arrangements. Travel documents are not released until booking has been paid in full. We continue to provide service to you until you have returned from your trip. Note: Except under extenuating circumstances, we only book 4 and 5 star hotels to maximize your chances of having a great experience.

3. VERIFICATION OF PERSONAL INFORMATION AND BOOKING DETAILS:

Responsibility for the accuracy of each traveler’s personal information and all booking details, is the sole responsibility of the lead traveler and/or person responsible for payment of services. Prior to the completion of any booking, the lead traveler and/or person responsible for payment of services is required to review and verify all information, including but not limited to: full legal names, dates of birth, gender, phone number, email address, mailing address, pricing, dates of travel, departure and return airports, accommodations, transportation, activities and excursions, travel insurance/protection, etc). The legal names of each traveler must match the name on their passport or other legal travel document. Lead traveler and/or person responsible for payment of services, assumes responsibility of all risks and associated costs for any errors and/or omissions for bookings made.

4. DOCUMENTATION REQUIREMENTS:

Valid travel documentation is required for entrance into other countries. Please check with the proper government authorities for specific entry requirements (passport, visa, vaccine, etc.) to avoid any issues when traveling international. We will not be held responsible for denied boarding or entry/reentry into any country or territory. Travelers assume sole responsibility for ensuring that all entrance requirements are met prior to travel and releases Luxury Vacations and Travel, LLC from a claims or responsibility due to travelers’ failure to comply with entry requirements. Generally, the expiration date of your passport is required to be valid for at least 6 months past your expected return date. Luxury Vacations and Travel, LLC is not responsible for any missing or inaccurate information provided by travelers. Although we will assist as a courtesy, it is the responsibility of the traveler to determine what travel documents are required and to obtain all necessary documentation prior to traveling.

5. HAZARDS:

We have no special knowledge regarding foreign entry requirements, unsafe conditions, health hazards, weather hazards, supplier bankruptcies, or the suitability for disabled persons of any portion of any tour. For foreign entry requirements, go to http://travel.state.gov/travel_warnings.html. For State Department travel advisories, go to http://travel.state.gov/travel_warnings.html. For foreign health requirements and dangers, go to http://www.cdc.gov/travel/index.htm. You hereby release us from any claims resulting in whole or in part from any problem covered in this paragraph and any other causes not within our control.

6. PAYMENTS:

Luxury Vacations and Travel, LLC charges a non-refundable planning fee prior to rendering any services. Fee amount is based on services requested and is separate from your trip costs. For each planning fee, you will be provided up to 3 quotes for the same trip request, which includes one modification or change (date, destination, resort, etc). You must book your trip within 30 days of paying the planning fee or a new planning fee is required. After 3 quotes or after 30 days from paying the planning fee (whichever comes first), a new fee is required for additional quotes/services. We only accept credit cards as a method of payment and will require a credit card authorization to be completed, signed and submitted to us. By completing a credit card authorization, you are authorizing Luxury Vacations and Travel, LLC to charge your credit card for the amount stated on the invoice.

For supplier payments, Luxury Vacations and Travel, LLC only accepts credit card as a method of payment. We will require a credit card authorization to be completed, signed and submitted to us. By completing a credit card authorization, you are authorizing Luxury Vacations and Travel, LLC to submit your credit card information to the applicable suppliers (such as cruises, airlines, hotel accommodations, ground transportation, meals, tours, etc.) for the travel services booked. Credit card authorizations protect both us and the credit card holder. Luxury Vacations and Travel, LLC will not accept any payments without a signed credit card authorization.

All deposits, payments and final payments are due by the dates specified by each supplier. If travelers fail to submit payments by the specified dates, their booking will automatically be canceled. Final payment is required prior to the issuance of travel documents and tickets.

7. PRIOR TO DEPARTURE:

Schedule changes are quite common today. We urge you to re-check exact flight times prior to departure and prior to your return. We do not have control over flight changes, cancellations or delays; and are not responsible for loss as a result of such. When booking flights with us, we cannot guarantee that families or traveling parties will be seated together.

8. CANCELLATIONS:

Cancellation policies vary by individual suppliers and each supplier can impose cancellation and change penalties up to 100% of trip cost. The lead traveler or person responsible for the payment of services should be careful to review and understand all supplier cancellation policies prior to completing a booking. All cancellations and no-shows are subject to supplier-imposed penalties and the penalties are the sole responsibility of the lead traveler or person responsible for the payment of services.

9. TRAVEL INSURANCE/TRAVEL PROTECTION:

Because the future is unpredictable and life happens, we highly recommend the purchase of travel insurance/protection for ALL travelers in a traveling party. Travel insurance can provide pre-departure coverage for Trip Cancellations as well as post-departure coverage for Delays, Medical Expenses, Baggage Delays or Loss and/or other coverage. Each travel insurance policy is unique (based on traveler needs) and coverage varies by insurance providers. If any traveler declines the purchase of travel insurance/protection, they are required to sign a declination waiver. By signing a waiver, you are certifying the following:

a. That you are aware of and understand all cancellation charges and change fees related to your
    travel arrangements.
b. That you understand that you may not be entitled to a refund should your travel plans change.
c. That in the case of cancellation, you agree to pay all applicable penalties imposed by the applicable
    travel supplier(s).
d. That you accept ALL risks of loss associated with your decision to “not” purchase insurance.

Once a policy has been selected and purchased, it is each traveler’s responsibility to thoroughly read and understand the entire policy. If there is anything you don’t understand about your policy, you can contact the insurance provider for clarification or explanation. When a claim has to be initiated, the lead traveler or each individual traveler (depending on the policy and procedures of the insurance provider) will submit the claim directly with the insurance provider.

10. FAA NO-FLY OR BANNED FLIERS LIST:

Before booking travel with Luxury Vacations and Travel, LLC, it is each traveler’s responsibility to know if they are on the Federal Aviation Administration’s (FAA) No-Fly or Banned Fliers List, which bars you from flying on commercial aircraft. If you are on the No-Fly or Banned Fliers List (BFL) and book flights/travel with Luxury Vacations and Travel, LLC, we will not be held liable for you being denied boarding on an aircraft. We will also not be responsible for any monetary refunds or other damages associated with denied boarding.

11. DISCLAIMER:

COVID-19: Luxury Vacations and Travel, LLC is taking many steps to thoroughly vet our hotels, airlines, and other suppliers to ensure that they are taking all the necessary precautions and following the recommended guidelines from the Center for Disease Control (CDC) and other governing authorities. However, an inherent risk of exposure to COVID-19 continues to exist in any public space where people are present. COVID-19 cases and deaths have been reported in all 50 states and across the globe and senior citizens and those with underlying medical conditions are especially vulnerable. By traveling, you voluntarily assume all risks related to exposure to COVID-19 and any other airborne viruses. While we do our best to provide you with up to date information, we will not be liable if you become sick or contract COVID-19 during travel and recommend each traveler assess their level of risk. We urge you to check the latest guidance from the CDC, the State Department travel advisories, as well as review the individual supplier’s websites before traveling.

Luxury Vacations and Travel, LLC is acting as intermediary, in accepting reservations or bookings for supplier services (such as cruises, airlines, hotel accommodations, ground transportation, car rental companies, meals, tour operators and any other travel services shown on your itinerary), which are not directly supplied by this agency. Luxury Vacations and Travel, LLC is not an agent of any travel supplier and has no control over refund policies and other rules mandated by those suppliers. This travel agency, therefore, shall not be responsible for any breach of contract (failure to provide services, failure to adhere to their own schedules, failure to honor their contracts, failure to pay a refund, etc.) or careless actions or omissions on the part of such suppliers or their subsidiaries, which result in any loss, damage, delay, or injury to you or your travel companions or group members. Luxury Vacations and Travel, LLC is not responsible for any “guarantees” made by any suppliers in regards to rates, bookings or reservations. This agency shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions or conditions outside of our control. By embarking upon his/her travel, the traveler(s) voluntarily assume(s) all risks involved with such travel, whether expected or unexpected. Luxury Vacations and Travel, LLC will not be held responsible for bodily injury/death, property damage or other loss, accidents, delays or inconveniences caused by (a) any act or omission of any travel suppliers, (b) any matter beyond our control, including but not limited to a delay or cancellation of a flight that causes you to miss any portion of the trip or (c) personal negligence or decisions. This includes inconveniences resulting from environmental conditions (cleanliness, bed bugs, pests), theft, assault, neglect, lack of amenities, faulty equipment or personal actions while traveling or staying with any supplier (airline, hotel, cruise line, vehicle transportation). The content herein applies to all traveling companions and/or group members of the traveler.

If any traveler has a criminal background, active warrants, owes child support, owes taxes, etc., they may be denied traveling by airlines, cruise lines, or any other supplier of travel and they may be denied entering another country. Travelers who are not allowed to travel because of any of the aforementioned, Luxury Vacations and Travel, LLC will not be liable. It is each traveler's responsibility to make sure they are cleared to travel. The content herein applies to all traveling companions and/or group members of the traveler. If you have unique family situations (i.e. single parent, custody issues, legal cases), it is your family’s responsibility to ensure that you meet the requirements to enter the destination that you are traveling to….whether it be by air, cruise ship, or land.

All bookings are subject to the applicable Terms and Conditions of the individual travel provider (airline, cruise line, hotel, etc.) including any applicable cancellation penalties. Please be advised that some airlines have implemented luggage fees and restrictions for air travelers. If you are traveling by air, please contact the airlines or visit the airlines' web sites for complete details regarding fees, restrictions and terms for luggage. Please understand that fees imposed by airlines are outside of Luxury Vacations and Travel, LLC’s control and that all guests are responsible to follow any applicable restrictions and to pay any applicable fees directly to the airline. Luxury Vacations and Travel, LLC highly recommends that travelers (and all traveling companions) purchase travel insurance to insure their travel investment. Travelers accept all risks of loss by deciding not to purchase insurance.
